Terms and Conditions
By applying for a stall at Makers’ Market, you agree to the following terms and conditions.
1) Applications
- Applications are managed via Eventaly. Create a profile and use it to apply to any future markets.
- Applications cannot be accepted by email or DM.
- Status updates (offered, waitlisted, declined) will be sent through Eventaly.
2) Accepting your stall
- If you cannot attend, decline within 3 working days of the offer being sent.
- Only apply for dates you can commit to. Persistent non‑responses or repeated declines may affect future offers.
3) Payment and invoicing
- Payment is required to secure your stall. Eventaly will issue the invoice.
- Invoices must be paid within 14 days. Unpaid places may be cancelled.
- Overdue invoices may lead to immediate cancellation of your stall.
4) Cancelling your stall (by the stallholder)
- If you need to cancel, email us as soon as possible at info@wonky-wheel.co.uk.
- Fees are refundable only if your place can be resold.
- Cancellations within 14 days of the market date are non‑refundable.
5) Cancellation or changes (by the organiser or venue)
- If the event is cancelled more than 14 days in advance by the organiser, 50% of the stall fee will be refunded to reflect venue and marketing costs already incurred.
- If the venue cancels, we will aim to transfer your booking to another market.
- If the event is cancelled at very short notice due to circumstances beyond our control (e.g. severe weather, safety issues), refunds may not be possible. We will do our best to transfer you to another market. If the new market has a higher fee, the difference will be payable by the stallholder.
6) Insurance and compliance
- You must hold a minimum of £2,000,000 public and product liability insurance. No exceptions.
- Evidence of insurance and any required safety certification must be provided before your stall is confirmed and be available on the day if requested.
- If you employ anyone on your stall, your policy must include employer’s liability.
7) Displays and space
- Do not bring additional rails, baskets, floor displays, or free‑standing signage beyond your table without prior written approval.
- Request approval at least 2 weeks before the market. Unapproved items may be removed on the day.
8) Risk assessment and legal compliance
- Complete a risk assessment for your stall covering sharp objects, trip hazards, electrical or gas equipment, and any product‑specific risks.
- You are responsible for ensuring all products comply with relevant UK legislation and standards.
9) Copyright, AI‑generated work, and reselling
- No items infringing copyright, trademarks, or other IP may be sold. This includes, but is not limited to, brands and characters such as Pokémon, Star Wars, Taylor Swift, Harry Potter, and Miffy unless you hold a valid licence.
- Applications featuring infringing items, AI‑generated artwork presented as original, or resold goods from mass‑market platforms (e.g. Temu) will be declined.
- If such items are found on your stall during the market, you will be required to pack up and leave immediately without a refund.
10) Loss, damage, and theft
- All stock and belongings are the stallholder’s responsibility at all times. The organiser is not liable for loss, damage, or theft.
11) Food and drink traders
- You must be registered with your local council and hold appropriate inspections and ratings.
- Provide evidence of food hygiene certifications and follow all relevant health and hygiene regulations.
12) Alcohol sellers
- You must hold your own premises licence or TENS. Provide evidence before your stall is confirmed.
13) Product safety certification (where relevant)
- Provide cosmetic safety assessments, CLP documentation for candles and diffusers, and any other legally required product safety certifications.
14) Set‑up, power, and pack‑down
- Full set‑up details, arrival times, and set‑up deadlines will be provided in advance.
- No power is available for stalls (indoors or outdoors). If you bring your own power or gas, all equipment must have valid safety certification and be used safely.
- Do not leave early without prior permission, as this can create safety issues.
- Any parking charges or fines are your responsibility.
15) Presentation and housekeeping
- Keep your area clean, tidy, and within your allocated footprint.
- Do not obstruct walkways, fire exits, or neighbouring stalls.
- Remove all waste at the end of the event. A charge may apply for waste left behind.
16) Marketing and promotion
- Maintain an active social media presence and actively promote the event on your channels.
- Use the official event name, dates, and any provided hashtags or assets where possible.
17) Photography, video, and press
- You grant permission for the organiser to take and use photos and video of your stall and products for event promotion, social media, and press.
18) Communication
- Pre‑event questions: info@wonky-wheel.co.uk
- On‑the‑day contact numbers will be provided separately in your trader brief.
19) Data protection
- Trader data will be used for application processing, event administration, and communications related to Markers Market, in accordance with UK data protection law.
20) Force majeure
- The organiser will not be liable for any failure or delay arising from events beyond reasonable control, including but not limited to severe weather, power failure, transport disruption, or government action.
21) Conduct and compliance on the day
- Follow organiser and venue instructions at all times.
- Any behaviour deemed unsafe, non‑compliant, or disruptive may result in removal without refund.
- The organiser reserves the right to relocate stalls or adjust layouts as required for safety and flow.
